Here are my case details
EB3 - 485 filed in Sept 2007 for me and spouse
My spouse now has a approved I140 in EB2.
Can we "interfile" and use my I485 app and interchange the dependents. I understand that we will have to use the 2010 priority date.
Or should we file new I485s that make the spouse primary and me dependent.
If "interfiling" is possible, how long does it generally take?

It is a good opportunity for state chapters. Unfortunately not many state chapters are yet formed despite having 8000+ members. We have members from every state but only a handful state members are actively working. Unless we all ourselves take responsibility and actively organize and participate in state chapters it is tough to use the grassroots level strength of this organization. We have more than a thousand members coming everyday to this site and posting ideas, opinions and what IV should do and what IV should not do. We all can achieve everything easily if everyone actively makes their state chapters alive and participate. If you feel that there is nobody in your chapter, then take a lead role and organize it. If you find that few members have signed up, and nothing is happening, then PM all those that are signed up and start working on action items.

Hi,
I have an EB2 that is pending with BEC. Everytime, I ask my employer for some kind of an application number that I can use to check the status online - they deny and instead provide me with the status themselves. Is there any other way to get the status of the LC?

The lawyers at Los Angeles' Fong & Chun are no exception, and in fact, this recent change affects some of our clients who do business in or own businesses in the Commonwealth of the Northern Mariana Islands (CNMI).
On 28 November 2008, "the United States" as defined for purposes of the Immigration & Nationality Act (INA) just got bigger, with the addition of the Commonwealth of the Northern Mariana Islands. Although there are probably wrinkles I have not yet read in the treaty, this essentially puts the CNMI on the same footing as Puerto Rico. Here's the cute part:
Because the CNMI will become part of the "United States" as defined by �101(a)(38) of the INA, "residence or presence in the CNMI before 28 November 2009 shall NOT be considered residence or physical presence within the USA for INA purposes. Thus, on 29 November 2009, all persons physically present in the CNMI are considered "to be present in the United States without inspection, by operation of law."
Will these PWIs (present without inspection) be eligible to adjust status? Unclear? Are they working "abroad" for purposes of L visas? Yes, as it turns out. One thing is clear: Legal Permanent Residents (so-called "green" card holders) who wish to base a naturalization application based on physical presence in the CNMI will NOT be able to do so for pre-29 November 2009 periods of time. I also asked my company lawyer and they are suggesting that since her status is H4 she can not work. For working on EAD she has to leave country and reenter on AP.
So a little confused here?

Hi All
I know a lot of July 2nd filers and some other who have been waiting for receipt notices...
There was an update yesterday by Mathew at www.immigration-law..that of the 800,000 applications only 400,000 have been receipted so far....May be it may take 2 more months for all the receipting updates to be done....
So everybody who is frustrated ..hang in there..have patience

The USCIS has yet to release the detailed progress report on the receipting delays in terms of the numbers that have yet to be processed for receipting. The only thing people know through various private websites just indicates that there are a plenty of people who are still waiting for filing fee checks cashed or receipt notices received for the cases which were filed as early as July 2, 2007, not to mention any later cases.
We reported earlier that the USCIS had allegedly received total of 800,000 cases for the July VB fiasco cases. There is an unconfirmed report that they have completed the receipting only half way through of the total, meaning approximately 400,000. There are no sources of information to verify or confirm the figures. However, if it is correct, the USCIS has yet to process mountains of receipting workloads ahead and the filers have some additional sleepless nights which they will have to endure for a while. AMEN!

My 6th year of H1b is expiring in the Sep 26, 2008. I already applied for my H1b renewal and already got the receipt. I'm Eb3 - ROW.
My and my wife also applied for our EAD renewal in jun 1, 2008 (Nabraska). didn't receive anything till now. My wife needs that to continue with her job, we already expedite the process last week.
I also visited home couple of months and and entered Us using my AP.
I have some question regarding all those issues:
1) Can I get a business license when i'm working with the H1b and have the EAD?
2) Does it going to have any effect on my green card process or H1b status?
3) If i have the problem then can i open the business license under my wife's name as she will be in the EAD.
4) My PD is May 2006. Any chance it will be current in next 6 months?
Please give your feedbacks with your expertise guys. it's been very help for long time for me. Thanks ahead

Inorder to apply for your 7th year extension, you should have an approved labor certification.
I am not sure if you can get an extension without an approved labor and I140.
You might have a problem.
Also, if you have an approved I40, you should have applied for an extension months before.
You really need a lawyer.

In the application filed, I received a query stating "Labor Condition Application is marked to indicate you are an exempt HIB dependent for the beneficiary based on the existence of masters degree from the United States. Please confirm your claim that you are an expemt for this beneficiary. If no United States masters degree exists for this beneficiary, the LCA is not valid and may require a withdrawal of the current petition and filing of a new petition with a new LCA that adhers to Labor Department's requirement for H1B dependents".
My Employer wants to reply that this was a clerical mistake..... Is this right? or should he file a new petition.
Can I file another petition if this petition is rejected?
Just saying its a clerical issue wont be sufficient. It might help if your employer attaches a new LCA along with the RFE reply. Worst case, you have to withdraw and file again with the correct/new LCA. If this is a fresh H1, then you are lucky in the sense that the quota is still open and you can refile without having to wait for another year.

Hi,
I am working under H1B visa and got married December last year. My wife applied for her H4 visa this month and when she got to the embassy for the interview, the consul checked and commented on the font size of her address in our marriage certificate. She said it was smaller than my address (well, she got a longer address before we got married, maybe that is why the census made it smaller) and said to my wife that it needs verification. The embassy then took all documents (her passport, our original marriage cert, etc.) and said they will call her when she needs to return for interview again.
Has anyone of you experience this? If so, any ideas how long it takes for them to call? BTW I'm Filipino. Thank you guys and God bless

It was very good. One should have told that even kids of skilled immigrants are counted on the quota. (Even a 1 year kid is counted as an skilled immigrant)

1) My GC was sponsored by company A. 240 days after my 485 was filed [I] moved to company B. Filed AC21 and using EAD. I am travelling on vacation using AP. At POE if I am asked who is sponsoring my GC, would my answer still be company A?/other
2) Do I need to carry AC21 docs? or will the employment letter from Company B suffice?
Please advise.

You got that right! Once a citizen you can choose to leave and enter whenever and stay outside the country for as long as you want.
