Guys,
I am currently working as Programmer Analyst for a company who is currently doing the GC. I have been with them for about 7 years.
Starting next month I am going to use my H1 7th year.
I am pondering about a new offer Firmware Engg. My GC detaisl are below:
PD: 06/2003 -- EB3
Education: MS
I am planning to stay in H1B, if possible with the new employer. But thinking of doing PERM and see if I can port my earlier date during I-140 filing.
Any suggestions or recommendations ...

Hi All,
I have efiled for my AP and EAD. I have received the RN for the same. I am planning to travel out of country by end of November. I am pretty sure AP will not be approved by that time. I am planning to travel on H1B visa. My attorney tells me that AP will not be approved if I travel before it is approved. I have to be in the country in order to get the AP approval. Is that true?

no, Its not true. AP can be approved while you're out of country.

H1 and H4 are 2 different classes.

I have to attend for H1 visa renewal...means I got extended H1 handy and All I have to do is get it stamped in chennai...
I was under the impression that i'm gonna take my wife along with me by adding another application to the selected date/time slot of mine....which they recommend in general..
if h1 and h4 belongs to two different classes how can I tie them together when selecting another applicant after filling those online 156 and 157's?
any thoughts?..
I'm sure many of the folks here wld have coem across this scenario as it invloves H4 - H1 stamping stuff...

If this has happened to you personally then you may be able to let Ombudsman know about it.
if it has happened to a friend of yours then maybe you can convince the friend to complain to Ombudsman.
Beyond this I doubt there is much that can be done.

Hi,
I've read conflicting information on whether one is eligible to receive unemployment benefits.
Specifically, i understand as a primary applicant in AOS status, one can not claim such benefits. But how about a derivative spouse, working on EAD , who lost her job? Can she claim such benefits as unemployment insurance. I've read that unemployment insurance should NOT be construed as a public charge, since its paid by the employer , when the employee is working.
So is it safe to get the basic unemployment benefits for a derivative spouse working in AOS status?

Yes, a derivative spouse can avail unemployement benefits and not jeopardize green card. Make sure she is eligible as per state laws. Each state has a different rule on who is eligible. Do some homework by calling your local unemployement office. I know of at least couple of immigration lawyers who discussed this on their newsletters. I know sheela murthy's website had that info too. Google for it and read.....

I have a PERM approval in EB2 with PD Sept 2005, and I140 approval few days back. I will be entering my sixth year in H1 shortly, wanted an advice whether to go for 3 year extension or 1 year extension, are there any demerits of 3 year extension with respect to H1 transfer in case of layoff, etc?

ravise is absolutely right, u will get H1 for the period remaining (6 years minus time spent on L1). Also, if u file in next year's quota (filing starts in Apr 2010), it cannot have a start date earlier than Oct 1, 2010. I don't think u can start working on H1 before that date, even if u file premium.
Why don't u ask you company to file in current year's quota -- there are still visas available.

Bush said he wants to improve the working visas, I think the prority needs to offer to Canadians because Canadinas use the same language and education system, the distance is closer. We need to call all the senetors, the working visas.etc. need to go to Canadina citizens first.

do they need to send the response via Fedex etc;
For all Premium Processing cases, the service center first sends a fax to the number provided in the I-907 premium processing request form before mailing the hard copy of the RFE. So your lawyer/employer might have already received the fax...Check with them...
