Does it mean that Imy application was filed in a wrong service center since I live in Minnesota?

Hi,

My company prepared for my PERM filing in EB2 category. They did all recruitement efforts. But at the time of filing, company annouced some lay-offs as "restructuring". Now my lawyer says, it is their policy not to file for PERM before six months of any lay -offs since some lay -offs involve same job title as my labor supposed to be filed. Since this is my lawyer's policy, My question is, is it safe to file PERM right now? What if I use different job title then the one my lawyer used before for recruitement efforts. (I understand he has to do new recruitement efforts for this ne job title, but is it safe?). What choices do I have, I do not want to delay my PERM filing. Please help...

I am planning to use AC21 by joining a company on this March month end , I asked new company to process H1, and its in progress.
In APRIL Visa Billiton my PD is current, as I have PD of JUNE 2001( EB2), my RD - JUNE 29, 2007 .at this stage if I change company what is the impact on my GC approval. Should I wait for some more time to join the new company?
Your advices are appreciated

Applying AC21 will trigger the IO to update the case, and if all is fine, in some case, the case could be approved, though not at all time, You can try your luck, In July when all cases were current happened to a colleague with PD2004, the case was approved in a week after mailing AC21. Check with an Attorney.

Immigration-law.com posted the news saying that

Wall Street (http://online.wsj.com/article/SB118455917060167397.html?mod=home_whats_news_us) Journal reports this morning that the USCIS is poised to announce its change of initial decision to reject all the July 2007 EB-485 new cases. The report indicates that they intend to accept and process some early July filing cases. Please stay tuned. Hmm...................................

Hi IV Gurus,



My Attorney filed my EAD application with invalid A# number in May,08 and my EAD got approved in July,08 with Invalid A# number. While going through my EAD card, I found invalid A# number on my EAD Card.



I sent a email to attorney regarding this one and he says that they filed EAD with invalid A# number and USCIS approved the EAD with Invalid A# number.It should not be an issue and the only way to �fix� this would be to file a new I-765 application and get a new EAD. It is certainly not an issue for employment eligibility at your current company".



Attorney also saying that they can file new EAD, but he needs send my Original EAD card along with the application.



My Questions are
1).Do I need send my Original EAD along with new EAD application ? Can I file with new EAD application with photo copy of my current EAD ?
2). Can I keep my current EAD (with Invalid A# Number on it) and apply next re-newel period with correct A# Number?
3).If I leave the country, while coming back at Port Of Entry do I see any problem? My I-485 and AP with valid A# Number and EAD with Invalid A# Number..
4).Do I see any issue, if I switch job with current EAD with Invalid A# Number?


Please give your suggestions.

My Daughter is traveling on AP, she does not have an EAD.
Her H4 is valid until 8/1/2010, and AP is valid until 10/10/2008. She is coming back here on 8/12/2008
Can anyone please help me with this question?
What will be her status, after using AP? Will she be on H4? I can not apply EAD for her.

There is no issue if your wife is the derivative applicant and gets her EAD through you. You can also start but it is more complicated since your business has to be doing excatly the same thing as your labor application. Also, i think you should get lawyers advice if you are starting it. There is no complication for your wife to start a business.

We are currently evaluating our options of starting a business on EAD, which should be coming within 3 months of filing of I485 in July. Does anyone know if I or my wife can start a business on EAD, are there any issues with it?

I have been in this country close to 11 years, and have PD of Feb 2004 EB3 India, and am thinking if I could apply for EB1 through another company than my employer. I am currently using EAD to work but I recently met someone who got GC through EB1 having started the process in 2008. I am really frustrated with the EB3 progress and have no hope so was thinking of this option. I have Masters with about 13 years of experience. Just wanted to check out if any of you are having similar thoughts and if this is a possible route ?
Also , is Labor substitution still a path or has that been blocked out ?
Any useful responses appreciated. TIA.

So High school guys(who works in mail room) don't messup with your application again. :)

I need to re-file my I-485 application which was rejected due to USCIS error (they could not find I-140).

Can anybody tell me what is the logic behind writing "DO NOT OPEN IN THE MAIL ROOM" on envelope while re-submitting I-485 appplication?

I will need to send to USCIS today. Please let me know ASAP.

I do not see any EB3 alone approvals (with no porting). Can people please update here if there are any EB3 485 Approvals so that we can get some pattern out of it.

What happens if there is any future foreign travel planned and COS decision does not come in time. Will she have to wait to home country till decision is heard and then go for H4 stamping or she can anyways go for H4 stamping even if COS decision is pending?

Can someone please help me below question


I got my finger prints and Advance Payrol receipt numbers from USCIS but not I765(EAD). I called USCIS about EAD receipt nbr but they said "System not yet generated I-765 receipt nbr". My attorny and employer not responding abt EAD receipt numbers and someware I have doubt they did not fill my EAD's as they know after getting EAD i can work for other employer which is 6 months from receipt date. Is their anyway I can track whether they filled my EAD form or not?

Also please advise is thier any alternative way I can fill EAD's.
